4. Recognize the incongruencies and short falls in the Texas Estates Code when seeking full restoration.

Instructors

Elizabeth Hart

Elizabeth Hart has worked with vulnerable persons under guardianship since 2007. She began at The Senior Source in Dallas assisting aged seniors on low and fixed incomes to stay independent in their homes and served as a guardian case manager. In 2010 she went on staff with the Dallas County Probate Court Investigators’ Office managing the Court Visitor Program and monitoring 3000+ adjudicated cases. In 2016 she took over management of the Court Visitor Program at Tarrant County Probate Court No. 2, eventually moving into investigations of guardianship applications and 1102s. Throughout her career with various probate courts, she has asked the question, “does this guardianship continue to be necessary”. As court staff she has had the distinct privilege of working to modify and/or restore the rights for dozens of persons, each with their own unique set of circumstances.

Monica Benson

Monica A. Benson is a Certified Elder Law Attorney* who has spent her 15 year career assisting clients with elder law needs.  She represents clients in a number of different areas, including drafting estate planning documents such as wills, trusts, and powers of attorney; probate matters for estates of all sizes, whether the decedent died with or without a will; guardianship matters, where she represents guardians, wards, or serves as a court-appointed attorney; and Medicaid planning, helping clients determine, obtain and maintain eligibility.  Monica also helps teach the next generations of attorneys as an Adjunct Professor at Texas A&M University School of Law, teaching Elder Law and a practical skills Wills and Estates Clinic.
